This Copyright Policy is a part of the Zinglin’s Terms of Use and sets forth the process by which copyright holders and their agents may remove allegedly infringing materials available on Zinglin.

Zinglin Media Private Limited (hereinafter referred to as “ZMPL” or “we” or “us” or “our”, as the context requires, and shall include its successors and assigns) operates a mobile platform application, inter-alia, App or portal called ‘Zinglin’ whereby user generated content can be uploaded, posted, shared or transmitted (such as via a stream) or otherwise made available through the Platform including videos, animations, comments, messages, reviews, photographs, sound recordings and the musical works (whether composed by such user or licensed to such user or of any other nature)  embodied therein and including but not limited to videos that incorporate locally stored sound recordings from a personal music library and ambient noise (“user generated content” , “content”, “User content” or any other similar reference) via our mobile application by users (hereinafter referred to as “you” or any other similar reference) and you may also be granted an opportunity to participate in various contests and promotional activities  on the mobile platform application (“Platform”) For the purpose of this Copyright Policy, references to Platform will include usage of our website, services, applications, products and content by you.

We respect the intellectual property of others. We will promptly remove materials in accordance with the provisions of the Copyright Act, 1957 and the rules made thereunder read along with the provisions of the Information Technology Act, 2000 (as amended from time to time.) when properly notified that the materials infringe a 3rd (third) party's copyright or other laws of India.

In filing any request, please ensure that your notice is complete; your statements are accurate and are supported by legally admissible evidence. If we request additional information necessary to make your notice complete, please provide that information promptly. If you fail to provide the required information, your request may not be processed further.

To request the removal of materials based upon copyright infringement, you must file a notice containing the following:

  1. Your full name, complete address, telephone and mobile number, and email address.

  2. A description of the copyrighted work that you claim has been infringed.

  3. A description of where on Zinglin app or website the material that you claim is infringing may be found, sufficient for us to locate the material (e.g., the URL for the video).

  4. A statement that you have a good faith belief that the use of the copyrighted work is not authorized by the copyright owner, its agent, or the law.

  5. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf, and provide documentary proof of the same.

  6. Your electronic or physical signature.

We may disclose notices with affected users and third-party databases that collect information about copyright takedown notices.

If you wish to challenge the removal of materials caused by a copyright infringement notice, you must file a counter-notification containing the following:

  1. Your full name, complete address, and telephone and mobile number, and email address.

  2. A description of the material that was removed and the location on Zinglin app/website where it previously appeared (e.g., the URL of the video).

  3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification and provide documentary proof of the same.

  4. A statement that you consent to the exclusive jurisdiction of Mumbai, India and that you will accept service of notice/process from the person who filed the original copyright infringement notice or an agent of that person.

  5. Your electronic or physical signature.

We will forward any complete counter-notification to the person who filed the original copyright infringement notice. The copyright owner(s) may elect to file a lawsuit against you for copyright infringement. If we do not receive notice that such a lawsuit has been filed within ten (10) business days after we provide notice of your counter-notification, we may restore the challenged materials. Until that time, your materials will remain removed.

This Copyright Policy shall be construed, interpreted and governed exclusively by laws of India, without reference to any conflict of laws.  In the event of any dispute between you and us in respect of this Copyright Policy, it shall be referred to a sole arbitrator appointed under the Arbitration and Conciliation Act, 1996 (as amended). The place and seat of arbitration shall be Mumbai. The language of arbitration shall be English. Subject to arbitration, the courts in Mumbai shall have exclusive jurisdiction in exclusion to other courts.
